'Record year' for ivory seizures

More elephant tusks were seized in 2011 than in any year since 1989, when the ivory trade was banned, international wildlife trade group Traffic says.

The group said elephants have had a "horrible year", with 23 tonnes of ivory seized - representing at least 2,500 dead animals.

Trade in ivory was banned in 1989 to save elephants from extinction.

But it has continued illegally because of huge demand in Asia, where it is used to make decorative objects.

"The escalating large ivory quantities involved in 2011 reflect both a rising demand in Asia and the increasing sophistication of the criminal gangs behind the trafficking," said a statement from Traffic, which monitors the trade in wildlife products.

"Most illegal shipments of African elephant ivory end up in either China or Thailand."

Shifting smuggling routes

The group said there had been at least 13 large seizures of ivory this year, amounting to more than 23 tonnes, compared to six last year of less than 10 tonnes.

"In 23 years of compiling ivory seizure data... this is the worst year ever for large ivory seizures. 2011 has truly been a horrible year for elephants," Traffic's elephant expert Tom Milliken said.

Traffic said the smugglers appear to have shifted away from using air to sea - in early 2011, three of the large scale ivory seizures were at airports but later in the year most were found in sea freight.

"The only common denominator in the trafficking is that the ivory departs Africa and arrives in Asia, but the routes are constantly changing, presumably reflecting where the smugglers gamble on being their best chance of eluding detection," it said.

In six of the large 2011 seizures, Malaysia was a transit country in the supply chain, Traffic said.

In the most recent case on 21 December, Malaysian authorities seized hundreds of African elephant tusks worth about $1.3 million (?844,000) that were being shipped to Cambodia.

The ivory was hidden in containers of handicrafts from Kenya's Mombasa port, Traffic said.

Mr Milliken said despite the seizures, there were generally few arrests.

"I fear the criminals are winning," he said.

Some environmental campaigners say the decision to allow some southern African countries, whose elephants populations are booming, to sell their stockpiles of ivory has fuelled the illegal trade.

Those countries - South Africa, Botswana, Namibia and Zimbabwe - however, deny this and argue they should be rewarded for looking after their elephant populations.

Cause of death unclear for Minn. shooting suspect (AP)

DULUTH, Minn. ? An autopsy on a man who died in custody while charged with opening fire in a northern Minnesota courthouse found the cause and manner of his death to be "undetermined," pending additional laboratory tests.

St. Louis County Sheriff Ross Litman tells the Duluth News Tribune (http://bit.ly/w2taof) those tests could take several weeks.

Nonetheless, Litman says foul play is not suspected in the death of 42-year-old Daniel Schlienz. Litman says the investigation is pointing toward a physiological or medical condition as the cause.

Litman says Schlienz requested medical attention on Christmas Day, but due to short staffing at the jail he was not given immediate medical care. He was treated for flu-like symptoms on Monday.

When his condition worsened, he was taken to a local hospital. He died Tuesday morning.

Morgan Stanley: 580 Jobs May Be Cut In The NYC Offices

Morgan Stanley CEO James Gorman LayoffsEarlier this month, Morgan Stanley announced it would be cutting 1,600 jobs globally during the first quarter of 2012.

We're now learning 580 of those cuts will occur in New York City.

Bloomberg reported that Morgan Stanley has filed its WARN notice for its New York locations. WARN notices must be filed according to state labor laws when a company with more than 50 employees plan on laying off workers in New York state.

According to the WARN notice, Morgan Stanley will be cutting 580 jobs in four different locations across Manhattan. Those locations include offices at?1221 Avenue of Americas,?1 New York Plaza,?1585 Broadway, New York and?750 Seventh Avenue. The layoffs will be on a rolling basis and began Dec. 15, when the 1,600 figure was announced. The reason listed was "economic."

Overall, Wall Street firms have axed more than 200,000 jobs this year in the face of the global economic downturn, instability in Europe and impending financial regulations that may affect bank revenues.

China to release six pandas into wild

Six captive-bred pandas will be freed into an enclosed forest in southwestern China next year in the first mass release of the highly endangered animals, the official Xinhua news agency said Wednesday.

It said the six, aged two to four, had been chosen from 108 captive-bred animals at the Chengdu Research Base of Giant Panda Breeding, and researchers believed the mass release would increase their chances of survival.

A total of 10 pandas have been individually released since 1983, it said, but only two remain in the wild, with the breeding centre taking six back after they lost weight, one found dead and the other also believed to have died.

Despite three years of preparatory training the confirmed fatality, Xiang Xiang, a five-year-old male, was found dead a year after his 2006 release, following a fight with wild pandas in a remote part of a nature reserve.

"Human-raised pandas have great difficulty surviving in the wild," Xinhua said, citing a statement from the breeding centre.

China engages in "panda diplomacy", using the endangered but iconic bears as diplomatic gifts to other countries, and also runs a lucrative trade hiring the animals out to foreign zoos.

Only around 1,600 remain in the wild in China, with some 300 others in captivity.

Obama OK's online gambling in states (Politico)

The Obama administration has cleared the way for states to legalize online poker and other forms of virtual gambling with the release of a new interpretation of the law, reports the Associated Press.

The Justice Department opinion, dated September but only released Friday, holds that the Wire Act of 1961 does not make it illegal for states to use the internet to sell lottery tickets to adults.

Previously, the Justice Department has held that wagers through telecommunications that cross state lines or international borders were illegal.

The question at issue in the Justice Department?s decision was confined to whether states like Illinois and New York could sell lottery tickets online to in-state adults, but the principles behind the DoJ?s decision has wide-ranging effects throughout the industry.

The Justice Department said that the ?ordinary meaning of the phrase ?sporting event or contest? does not encompass lotteries,? which sparks a precedent in interpretation that could free up states to legalize other forms of virtual gambling.

?The United States Department of Justice has given the online gaming community a big, big present,? said I. Nelson Rose, a gaming law expert who consults for governments and the industry, according to the AP.

The new decision would eliminate ?almost every federal anti-gambling law that could apply to gaming that is legal under state laws,? Rose wrote on his blog.

If a state were to legalize intra-state gambling, ?there is simply no federal law that could apply,? given the new decision, he said, according to the AP.

NBA season finally set to tip off on Christmas (AP)

Finally, the conversation changes.

It's time for the NBA to ditch the dollars and nonsense of the lockout for the alleys and oops in Lob City, the new nickname for the suddenly exciting Los Angeles Clippers.

For months, all the talk was about lockouts, salary caps and mediation. Now there are games that count as a new season begins Christmas Day.

For all practical purposes, Clippers fans have been locked out of competitive basketball for the better part of three decades. Now they get entertainment of the highest order ? watching Blake Griffin throw down lob passes from Chris Paul.

The 2011-12 season, shortened to 66 games, debuts Sunday when five marquee games will be played from morning deep into the night. This marks a first step for the league as it looks to bury a damaging offseason marred by a five-month labor dispute and several stars trying to force their way out of town.

The day begins with Boston and New York and then goes to an NBA Finals rematch with Miami at Dallas. Next up is Chicago at the Lakers, followed by the small-market special ? Orlando at Oklahoma City ? before CP3 makes his regular-season debut as a Clipper at Golden State in the nightcap.

"The lockout was hectic for everybody," Timberwolves forward Michael Beasley said. "We were bored! Now we feel like we've got a purpose in life. We can do what we do best."

It's time.

It's time for Derek Fisher to be seen in Lakers gold, not Brooks Brothers gray.

It's time for postgame news conferences with LeBron James and Dwyane Wade, not post-meeting sessions with David Stern and Adam Silver.

It's time for Dirk Nowitzki and the Dallas Mavericks to defend their title on the court, not for Jeffrey Kessler and the players' union to defend their decision to disband in the courts.

"I don't even want to talk about the lockout any more, man!" Oklahoma City forward Kevin Durant said. "It was just so frustrating to go through that and everything that went on, us meeting and not meeting and not coming to an agreement and fans getting upset with us. It was tough. But I'm glad we got through it."

It didn't look so good for a while. Once the dispute was finally settled, a whole new drama broke out with Paul and Dwight Howard looking for trades out of New Orleans and Orlando.

Howard eventually softened his stance, but his future is still the focus in Orlando.

"I don't think our situation is going to go away," Magic coach Stan Van Gundy said. "But I think it'll be a lot more focused on the games than there has been (focus) on the lockout."

The Lakers thought they had a deal for Paul, but Stern, acting as the owner of the Hornets, nixed that, and another crisis was born. The Clippers swooped in at the end, seizing some of the spotlight from Kobe and the Lakers for the first time since, well, ever.

"Hey, that's got to be driving Kobe," Lakers Hall of Famer Magic Johnson said. "That should drive (Pau) Gasol and (Andrew) Bynum and those guys and Derek Fisher to say, `Hey, no way I'm going to let them take over Los Angeles.'"

The two teams met twice in the preseason, and the rivalry quickly escalated. Bryant injured his wrist on a hard foul in the first game and Lakers agitator Matt Barnes shoved Griffin to the court in the second game.

That wasn't the only miniseries infused with more intensity and energy than any exhibition game in recent years.

The Timberwolves were buoyant after finishing their second game against the Bucks with a 12-0 run to finish the preseason 2-0. James and Quentin Richardson were seen trading shoulder blocks all the way down the floor in Miami's preseason finale against Orlando.

"That's our sanctuary. When we get out between the lines and we're playing, that's all that matters," Richardson said. "And that's definitely our escape from anything going on, or anything negative or anything like that."

The melodrama surrounding Paul's request to be traded from New Orleans could have ripple effects throughout the Western Conference. The Lakers have been grousing since losing out on Paul and sending Lamar Odom to Dallas, but they weren't the only team hurt by that decision.

The Rockets had agreed to send Kevin Martin and Luis Scola to the Hornets as part of a three-team deal that would have landed them Gasol. Instead, they had to abandon any designs on signing Nene, go with Sam Dalembert in the middle and do some serious damage control with Scola and Martin.

While all the drama was unfolding, the Thunder have been playing the role of the young, hungry contender, ferociously working while no one was watching and preparing to throw nothing but haymakers as soon as the bell rings.

The Heat are back for another run at the title. James, Wade and Chris Bosh had the whole league against them after a presumptuous welcome ceremony on South Beach. But the spotlight hasn't been quite as bright while everyone has been looking toward the Clippers and Magic, where Howard's wishes seem to change by the day.

"It's good to see other guys around the league get that attention," Wade said. "I think they got enough of us last year. It's good to see other teams, other franchises, get that spotlight for a while. Hope they enjoy it."

The fan hunger is there as well. The Clippers sold out their game against the Lakers, and the first in that series was the most viewed preseason game in NBATV history.

The Timberwolves had 15,000 people attend their home preseason game against the Bucks, and another 2,500 turned out for a free practice on a Monday afternoon just to get a glimpse of Ricky Rubio.

More than 10,000 fans watched a free practice with the New York Knicks, and the Thunder's rabid fan base packed the arena for Durant's return to the court.

"We had to sacrifice a little bit of time and there were some harsh words thrown our way, but at the end of the day, everybody got what they wanted, which was basketball," Durant said. "That's what we worked hard for, is to play the game of basketball. We had to work the business part out and now we're just back to basketball."

Let the games begin.

In Memoriam: Nate Dogg, Heavy D Among Stars We Lost In 2011

MTV News remembers 'Jackass' daredevil Ryan Dunn, Alice in Chains bassist Mike Starr and Cali Swag District's M-Bone, among others.

This year we lost some of our brightest stars: artists that spanned the genres of rock, hip-hop and pop, as well as TV and film. They were at different stages in their careers — some just starting to rise, others already legends — but all left a distinct mark on pop culture, and their deaths affected us deeply.

Beloved hip-hop icons Nate Dogg and Heavy D influenced the generations of artists who followed them. Nate (born Nathaniel Hale) died at age 41 after suffering several health setbacks related to a stroke. One of the key players in the birth of the West Coast G-Funk sound, the crooner's silky smooth vocals touched classic tracks from Snoop Dogg and Warren G to 50 Cent and Ludacris. Fun-loving Heavy D, a major force in the New Jack Swing era, had hits with songs like "We Found Love" and "Nuttin' But Love," but he had also branched out into film and theater. He was 44 when he died this past fall.

We lost Mike Starr, former bassist for the groundbreaking Seattle grunge band Alice in Chains. Like Amy Winehouse, who also died this year at the age of 27, Starr's talent was often overshadowed by dependency on alcohol and drugs.

Gun violence claimed the life of 22-year-old Montae Talbert, the Cali Swag District dancer otherwise known as M-Bone. And Australian actor Andy Whitfield, who got his big break when he was cast as the lead in the Starz TV series "Spartacus: Blood and Sand," was 39 when he succumbed to non-Hodgkin's lymphoma.

Finally, the MTV family mourned the death of "Jackass" daredevil and "Viva La Bam" star Ryan Dunn. The 34-year-old died on a rural Pennsylvania road along with his 30-year-old passenger, Zachary Hartwell, when their car slammed into a guardrail and caught fire.

Nicaragua vs Costa Rica at UN court on river works (AP)

THE HAGUE, Netherlands ? Nicaragua has filed a suit at the U.N.'s highest court seeking to stop Costa Rica from building a road along the banks of the San Juan river that it claims is destroying the environment.

The legal action is the latest in an ongoing dispute between the two countries over rights to the ecologically sensitive river that forms a common border.

Nicaragua claims the construction threatens water quality and aquatic life.

The suit at the International Court of Justice filed Thursday comes just nine months after the same court ordered both countries to pull their armed forces out of the area.

In the earlier case, the court refused Costa Rica's demand to order Nicaragua to halt dredging, saying it was unclear it was causing irreparable damage.

Tax cut fight ends ugly year for Boehner

(AP) ? John Boehner vowed early on that as speaker, he would let the House "work its will." At the end of his first year in charge of the fractious Republican-controlled chamber, it's clear he has little choice.

An uncompromising band of conservatives, led by GOP freshmen to whom Boehner owes his speakership, has repeatedly forced him to back away from deals with President Barack Obama, Democrats and, this week, even one struck by Senate Republicans. Gridlock, again and again, has defined Congress in the Boehner era even as Americans fume and the economy continues to wobble.

In a closed meeting Monday night, a few Republicans gave voice to widely whispered questions about Boehner's ability and willingness to represent them in negotiations with the White and Senate. They were incensed that the Senate had overwhelmingly passed a two-month extension of a payroll tax cut for 160 million Americans and then left town for the holidays. House Republicans were demanding a year-long tax cut, but there was no longer a Senate in session to negotiate with.

How could this have happened, Rep. Duncan Hunter, R-Calif., asked Boehner, according to multiple officials who were present.

Rep. Cliff Stearns was more direct: Was the Senate deal really a total surprise? Or did Boehner give some sort of tacit agreement?

Boehner tersely, adamantly denied doing so, according to those present. He said he had not expected the Senate's overwhelming approval of the two-month extension.

"I take the speaker at his word that he was surprised by the strong support for the payroll tax legislation in the Senate, which approved it with 89 votes, including from 39 Republicans," Stearns said Tuesday in a statement to The Associated Press.

Did Rep. Jeff Flake believe Boehner? "Oh, I don't know," said the Arizona Republican, grinning and edging away. "You'll have to ask the leaders that."

Boehner "has told us he did not agree to this," said Rep. Virginia Foxx, R-N.C. "I am not a mind reader, and I can only go on what the speaker has said."

At midday Tuesday, the House rejected the Senate's two-month extension, leaving hanging the fate of the tax cut for 160 million Americans, unemployment benefits for 2 million more, and Medicare reimbursements for physicians to treat 48 million Medicare beneficiaries. As it now stands, Social Security taxes on workers will by up to $40 a week on Jan. 1, people out of work for more than six months will start losing jobless benefits and doctors will see their fees for treating Medicare patients cut 27 percent.

It was an ugly end to a year of gridlock on Capitol Hill that earned Congress historically low approval ratings and the nation a downgrade in its credit rating. The policy debate changed, but the question was the same each time: Compromise, or no deal?

First was the fight last spring over how many billions of dollars to cut from the 2011 federal budget after talks strayed far below the Republicans' campaign promise to slash $100 billion. Rather than standing firm and allowing parts of the government to shut down until enough lawmakers came around, Boehner did exactly what the tea partiers campaigned had campaigned against ? he negotiated with Obama and Senate Democrats on smaller spending cuts.

"Cut it or shut it!" chanted a crowd of tea partiers outside the Capitol.

OK as a campaign slogan, but not a viable technique for lawmaking in a divided government. Some of the 87-member freshman class, swept to power by tea party enthusiasm, insisted that Boehner rewrite the GOP proposal. He did, and submitted instead a proposal to cut about $61 billion? the pro-rated remainder of conservatives' campaign pledge to cut $100 billion in the 2011 budget year.

Moments before the government was set to shut down, most of the freshman class voted for the final, six-month deal to cut $38.5 billion.

Soon followed the showdown over whether to raise the nation's debt limit. Deficit cuts totaling $2 trillion or more over a decade would be the price for Congress to raise the nation's $14.3 trillion debt ceiling and continue borrowing 35 to 40 cents of every dollar it spends. Failure to lift that cap could cause the U.S. government to default on its bills and previous borrowing for the first time in its history. Experts warned the cascading reaction in world financial markets could trigger another recession.

Massive spending cuts were mandatory, and raising taxes was out of the question, Republicans said. Boehner assigned his lieutenant, Majority Leader Eric Cantor, to negotiate a blend of spending cuts into the deal with Vice President Joe Biden. But Boehner was meeting secretly with Obama on a grander deal to cut as much as $4 trillion. House Republicans were furious when they learned about it, and the speaker broke off his talks with the president.

In the end, Congress agreed to a deal cutting spending by more than $2 trillion and raising the debt limit by nearly the same amount. But the bill was still highly unpopular among House conservatives who felt it didn't go far enough in slashing government spending.

And finally, the end-of-year debate over the payroll tax cut. The House voted Tuesday, 229-193, to kick the measure back to the Senate, where the bipartisan two-month measure passed on Saturday. Senate Majority Leader Harry Reid, D-Nev., says he won't allow bargaining until the House approves the Senate's short-term measure.

Back to gridlock.

The speaker's allies say his patience and his willingness to pull back is preventing conservatives from trying to replace him.

"It's a maturation process" for the House's feisty newcomers, said Rep. Steve LaTourette, a fellow Ohioan and close Boehner ally. "They came to town not knowing how this place works. Now that they have a year under their belts, we're in a much better place going into next year."

Why Britney Spears, Bruno Mars Didn't Make Best Artists Of 2011 List

We attempt to explain the madness behind MTV brain trust's methods.

On Thursday, MTV unveiled our picks for the Best Artists of 2011 ... a list fittingly topped by none other than Katy Perry, who bested big-name stars like Nicki Minaj, Adele, the Throne and Lil Wayne to take home the honor.

It wasn't an easy choice, but we'd like to think we got it right. After all, Katy had three #1 singles — with a possible fourth looming on the horizon — this year, took her massive California Dreams Tour to arenas around the world, won Video of the Year at the 2011 VMAs and frequently posed for photo-ops like this. It was a pretty impressive 12 months, to say the very least.

Still, it took a whole lot of back-and-forth from our panel of experts — a brain trust made up of folks from MTV News, MTV Music and Talent and MTV.com — before we could declare Katy our #1 choice ... and needless to say, as we've been unveiling our picks, not all of you agree with our decision. But it seems that most fans don't have a problem with who made our list ... they're taking issue with who didn't.

And for all of the names bandied about by MTV.com readers, it seems that three keep coming up time and time again: Britney Spears, Bruno Mars and Pitbull, artists who each have a legitimate claim at being included in the conversation, if not placing in the top 10. So why didn't they? Let's try to explain.

Before our brain trust met, each department gathered and created a list of their top 12 picks for Best Artist of 2011. Those lists were then compiled, and we used some good old-fashioned arithmetic to determine an overall top 12 (everyone's #1 pick was awarded 12 points, each #12 pick got 1). From there, we debated, eventually settling on the top 10. And here's where the snubs begin: It seems that, while Brit, Bruno and Pit made everyone's top 12, none of them placed high enough to accumulate enough points ... though all three were in the discussion, they each finished toward the bottom of the overall top 12 and, really, we couldn't move them up far enough to make the final 10. And, more specifically, we couldn't find anyone in the top 10 we felt could be taken out.

Why? OK, let's break it down. Though Britney had a big year, our brain trust couldn't get past the fact that the story of her year hadn't changed all that much from previous years. She seemed to still be the princess of pop at the peak of her career, but she didn't necessarily gain any new ground this year. And though her chart-topping "Hold It Against Me" made tons of noise, Adele, Katy and Rihanna had lengthy Billboard reigns that were too difficult to overlook. Still Britney didn't finish entirely empty-handed. Her (really excellent) "Till the World Ends" placed at #10 on Bigger Than the Sound's 25 Best Songs of 2011 list.

As far as Bruno is concerned, he came quite close to cracking the top 10, but the brain trust took issue with the fact that his Doo-Wops & Hooligans album came out last year, not to mention that, outside the success of "Grenade" in early 2011, his subsequent singles didn't reach #1 (though "The Lazy Song" did make it to #4). And if all of that seems like nit-picking, well, some of us on the brain trust would agree with you, but sadly we were out-voted. And when it came to Pitbull, let's just say that while he had a monster hit with "Give Me Everything" (which came in at #6 on the brain trust's Best Songs list), most of the panelists couldn't get past the fact that he never quite got around to matching that song's success ... ubiquitous Dr. Pepper ad campaign aside.

So, there you go. Like we said, putting together a top 10 wasn't easy, and fans of Britney, Bruno and Pitbull probably have some legitimate gripes. Hopefully, explaining the madness behind our methods will help assuage some of their anger. Then again, probably not.

?It?s been rough,? Hill said. ?He?s such a fighter.?

A month after Hale was diagnosed on March 28, Landon and 12 other Murrieta firefighters formed a triathlon team ? in support of Hale?s cancer fight ? to compete in the March 31 California Ironman 70.3 competition in Oceanside.

Since then, the group has been able to raise nearly $9,000 for the Firefighter Cancer Support Network, which also has supported Hale through his cancer battle.

?We wanted to give back to (the cancer support network), especially after hearing all that they did (for Hale),? Hill said. ?This is our fire family. We?re very close.?

The triathlon firefighters presented a check for $8,623.07 ? raised with corporate sponsorships, a car wash, community donations via the ?Fill the Boot? campaign and personal donations, Murrieta Fire Department Fire Chief Matt Shobert said.

Dan Crow, the California coordinator for the network, accepted the check Saturday. City Council members Rick Gibbs and Randon Lane were on hand for the presentation.

?And this is why our community is always so proud of our department,? Lane said.

Hale said he has been blessed in his successful fight against his aggressive cancer. Thanks to a new pill called Crizotanib that he takes twice a day, Hale will be able to live out the rest of his life even with cancer cells present in his body.

He said his family, his fire family and the Firefighter Cancer Support Network have been pivotal in his fight against the disease.

?We talk about a fire family,? Hale said ?There is no comparison to what the family has done for me.?

Hale said the support network delivered a cancer-fighting informational kit and received two separate phone calls from firefighters around the country who were fighting the same type of cancer.

He said the network helped him through the ?what-do-you-do-now stage.?

?It?s been amazing what they?ve done,? he said.

The California Ironman competition includes a back-to-back 1.2-mile ocean swim, a 56-mile bike ride through Camp Pendleton and a 13.1-mile run by the pier.

Over 25 percent of the Murrieta Fire Department suppression personnel registered to compete.

Members of the Ironman Team MFD 2012 include Richard Curran, Forest Hansen, David Perez, Shad Chanley, Dan Grassmeier, Andy Schmader, Sean DeGrave, Ryan Roufs, Jeff Asbury, Landon Hill, Travis Anderson, Jake Wright and Matt Shobert.

AP Newsbreak: 9 states to win early learning grant

(AP) ? Nine states will share $500 million in grant money won in a high-profile competition intended to jump-start improvements in often-overlooked early childhood programs, The Associated Press has learned.

The winners to be announced Friday at the White House are California, Delaware, Maryland, Massachusetts, Minnesota, North Carolina, Ohio, Rhode Island and Washington, according to an administration official who spoke on condition of anonymity because the winners had not been officially announced.

The money to aid the nation's youngest learners is part of the Obama administration's cornerstone education initiative ? the "Race to the Top" grant competition ? which has states competing for federal dollars to create programs that make schools more effective. Last year, it handed out $4 billion in similar grants focused on K-12 education.

The goal of this competition is to get more children from birth to age 5 ready for kindergarten. Thirty-five states along with the District of Columbia and Puerto Rico applied for the chance to win between about $50 million to $100 million apiece in prize money. The winnings are to help build statewide systems that affect all early learning programs, including child care, Head Start centers and public or private preschools.

Billions are spent annually in America on early education programs, but the quality and availability of those programs varies greatly. Roughly half of all 3-year-olds and about a quarter of 4-year-olds do not attend preschool, said Steve Barnett, director of the National Institute for Early Education Research at Rutgers University.

Kids who attend quality early education programs have been shown to do better in school, be less likely to spend time in prison later and to make more money as adults. But children from low-income families who start kindergarten without any schooling are estimated to start school 18 months behind their peers, a gap that is extremely difficult to overcome.

To win, states were asked to demonstrate a commitment to making such programs more accessible, coordinated and more effective. Providing professional development for teachers and creating ways to assess the education level of kids entering kindergarten were among the areas states were asked to focus on in their application.

Education Secretary Arne Duncan and Health and Human Services Secretary Kathleen Sebelius were to announce the winners at the White House. The two agencies jointly administered the competition. HHS oversees the federal Head Start program, which provides early education to nearly 1 million low-income children.

Last month, Obama announced new rules that require lower-performing Head Start programs to compete for funding. The Education Department also has proposed creating a new office to oversee the grants and better coordinate early learning programs.

Samsung Galaxy Note for AT&T to ditch Exynos, sport 4G LTE?

Is a 4G LTE-capable Galaxy Note headed stateside? According to PocketNow, that could very well be the case. Rumour has it Sammy's bringing a branded variant of the 5.3-incher, purportedly the SGH-I717, to AT&T's lineup sometime in early 2012. We'd already seen the Note pass through the Commission's gates and had anticipated a U.S. debut would soon follow, but that version -- the GT7000B -- might simply be a color variant of the currently available international model. An operator tramp stamp and 700MHz / 1700MHz radios won't be the only changes reportedly on deck, as this tablet / phone in-betweener is said to pack a dual-core 1.5GHz MSM8660 -- similar to the HSPA+ 42 and LTE-friendly Qualcomm chipsets found in the Skyrocket and T-Mobile's SGS II. Bear in mind, folks, that this is all still hearsay. Until we get word of an official release, you'll just have to make do with an unlocked import.

World trade body agrees to Russia becoming member (AP)

GENEVA ? The World Trade Organization agreed Friday to allow Russia to become its newest member, giving a critical boost to the ailing economy of its biggest trading partner, the European Union.

Until now, Russia has been the only member of the Group of 20 leading world economies still outside the WTO, the global body that sets legally binding rules for international trade and mediates disputes.

The deal is expected to quickly increase EU exports by some euro4 billion ($5.2 billion) a year, EU trade officials say. Under the deal, Russians will be able to buy European-made goods at far lower prices and to sell its oil and gas more efficiently.

The 27-nation EU bloc is Russia's biggest trading partner for agriculture, fuels, mining and manufacturing. The EU buys 52 percent of Russia's exports, including the fossil fuels that keep Europe running. Russia, in turn, is third-biggest customer for EU exports, after the U.S. and China.

Elvira Nabiullina, Russia's minister of economic development, hailed the deal and said Russia is ready to help counter the risks of the global economic slowdown.

"We are ready to counter these risks actively," she told WTO trade ministers, just after their decision to welcome Russia.

The agreement is also likely to provide a boost for Russia's heavily state-managed economy, trade experts say, because it would bring the nation under international trade rules that could give outside investors more confidence.

"The EU has high expectations of Russia as a responsible partner able to respect rules," EU trade chief Karel De Gucht told the WTO.

As a WTO member, Moscow would provide annual reports to other members on its continuing privatization and gradually lower its average tariff ceiling to 7.8 percent from its current 10 percent.

A final hurdle to joining the WTO was the deal Russia signed with Georgia, its neighbor with whom it waged a brief war in 2008, to allow a neutral company to monitor all trade between the two nations.

Russia would become a WTO member next year, 30 days after it notifies WTO that the Russian Duma has ratified membership.

Did Bumbo ignore child safety in favor of profits? (Reuters)

(Reuters) ? Like millions of other parents over the past several years, Kevin and Lucy Ferrell used a new baby product called the Bumbo Baby Sitter that they bought at Toys R Us to prop up their son, Colby. The simple molded plastic seat is more upright than a bouncy chair, and less rigid than a high chair, making it a hit with parents looking for new infant gear.

But when 9-month-old Colby fell out of the seat and fractured his skull, his parents learned very quickly that the seat wasn't ideal for a small, moving child.

"He arched his back up and he kind of flipped out of it sideways and backwards and rolled right off (the table)," Kevin Ferrell says. "It just happened in a split second."

Bumbo, which is used to help babies sit up before they're able to do so on their own, has been an unquestioned success in sales - with nearly 4 million sold in the U.S. since 2003. But its safety record is uncertain.

The South African company recalled Bumbo in 2007 after a spate of 28 injuries reported to the Consumer Product Safety Commission - including numerous skull fractures - and placed warning labels on the seats that said they shouldn't be used on elevated surfaces. Bumbo company records obtained as part of a lawsuit the Ferrells filed in June against the company and Toys R Us, where the product was purchased off their baby registry, show some 300 reported incidents, including some in other countries, mainly Great Britain. The suit was filed in U.S. District Court in Austin, Texas, where the case is still in a pretrial phase.

Then in late November, the CPSC issued an unusual warning that there had been another 45 incidents since the recall, and that it had learned of another 18 older cases. It also noted that children were hurt both when the product was elevated and when it was on the ground.

Ross Cunningham of the Rose Walker firm in Austin, who represents the Ferrells and says he has settled a dozen lawsuits over Bumbo's safety, alleges in the lawsuit that Bumbo "has taken no effort" to reconfigure the product to prevent children from getting out of it, "despite having actual knowledge of the dangers associated with the Bumbo Baby Sitter...and the potential of the Bumbo Baby Sitter to cause serious injury to children."

Bumbo's U.S. attorney, Tarush R. Anand, says he cannot comment on the litigation, but did provide a statement from Bumbo, in which the company says the product is safe. "The Bumbo baby seat is a safe product for infants when it is used as intended: on the floor and never on an elevated surface," the statement says. "Children should always been closely supervised when they are in the Bumbo seat." The company also says it is working with the Consumer Product Safety Commission to educate parents on the correct use of the seat.

Toys R Us is accused in the most recent lawsuit of knowingly stocking a baby product that has caused injuries. One of the company's buyers is quoted in the litigation as saying under oath that she had never seen an infant product like that without a safety restraint, and that after learning about the severity of the injuries, she didn't think it was safe.

Nancy Cowles, executive director of the advocacy group Kids in Danger, notes the product - unlike cribs, car seats and high chairs - is not governed by any government or industry standard. The Ferrell lawsuit says Toys R Us has a huge profit margin on the seats and has ignored even voices from within the company about their safety.

Toys R Us spokeswoman Katie Reczek said in a statement in response to questions that the retailer followed the terms of the recall and stands by the decision to keep selling it.

"The safety of the products we sell is, and always has been, our highest priority," Reczek said. "At the time of the recall of the Bumbo Baby Sitter, we immediately removed the product from our store shelves, and worked with Bumbo to update the warning labels on the packaging, as was required. This warning label cautions parents not to use the Bumbo on elevated surfaces. Due to the recall and labeling process, the product was off the sales floor and was not available for purchase for several months. We continue to offer Bumbo products in our stores, and as always, we closely monitor all product safety issues."

Its only competitor, bbPOD, added a seatbelt after the Bumbo recall.

Attorney Cunningham alleges in the Bumbo lawsuit that safer alternative design existed. "Specifically, Bumbo could have incorporated any combination of the following design changes: made the Bumbo Baby Sitter wider at the base, raised the side and back walls of the seat, installed a bulbous pommel on top of the post in between the child's legs, and incorporated a safety harness, seatbelt or other securing device...that would sit low and tight across the child's hips. These, and possibly other design improvements, would have prevented a child like (Colby) Ferrell from falling out of the Bumbo Baby Sitter."

The Ferrells are now evangelists for seatbelts. Says Kevin Ferrell: "For me, it was important, if nothing else, to try to prevent (this) from happening to future parents and kids."

Canada, a country that prides itself on having one of the world?s most liberal systems for immigration, just banned women from wearing veils while taking the oath of citizenship.

Limited to citizenship ceremonies, Canada?s new rules make it the second nation after France to ban face-covering garments in public, although there are a number of countries in Europe that have begun to target Islamic fashion and religious observance in the past few years.

France?s conservative government passed a veil ban in October 2010, a law that went into force in April 2011. The Netherlands also indicated in September that it would impose a ban on veils because the ?wearing of clothing that completely or almost entirely covers the face is fundamentally at odds with public life.? In August 2009, Switzerland outlawed the construction of new minarets at Swiss mosques.

Canada?s minister of citizenship and immigration, Jason Kenney, told reporters that he found it ?bizarre? that Canada?s rules had once allowed women to wear face-concealing garments during their citizenship ceremonies.

"Frankly, I found it bizarre that the rules allowed people to take the oath with a veil on,? Mr. Kenney was quoted by the Guardian newspaper as saying. "It is a matter of deep principle that goes to the heart of our identity and our values of openness and equality."

It might not be immediately apparent why three secular nations with long-liberal policies of immigration would suddenly want to take on the question of what Muslim citizens wear in public. But these bans come at a time of severe economic distress, when the influx of outsiders ? and particularly those distinguished by their clothing ? from the Middle East, North Africa, and South Asia have become points of domestic tension. When conservatives warning of ?creeping sharia law? in Western society meet up with liberals worried about the supposed ?dehumanizing? effects of Muslim dress on women, such bans can become popular.

But popularity aside, critics warn that bans on veils can also alienate Muslims who are attempting to integrate into Western society, and undermine the very notions of tolerance that Western societies once treasured.

While not all Muslim women wear head coverings, those who do wear them say they do so to conform to the Koran?s injunction for women to be ?modest? in their clothing. Women in some South Asian countries such as India and Pakistan wear a simple chador, a scarf that covers their hair, but not their face. Some women in Afghanistan wear a burqa, which is a head-to-toe gown with a mesh-covered hole to look out from. A niqab is a veil that covers most of the face, except for the eyes.

Western nations aren?t the only countries that ban veils. Tunisia banned veils in 1981, Turkey banned them in 1997, and Syria banned veils in universities in July 2010. All three countries see themselves as secular nations with Muslim majorities, although Turkey?s most recent president has loosened such secular rules in recent years, and the authoritarian regime of Zine El Abidine Ben Ali has been replaced by a coalition of democrats and Islamists.

In an interview with the Associated Press, Mr. Kenney indicated that the ?burqa ban? would be limited solely to public offices, offering state services. 

?We shouldn?t have the state using its power to dictate what people choose to wear in their private lives, but when there are important points of intersection with the state in obtaining state services I think it?s entirely reasonable for people to show who they are,? Kenney told the AP.

Canada?s Muslim citizens, who largely cluster in major cities such as Toronto and Ottawa, are currently estimated to be 940,000, or 2.8 percent of the population. But a recent study by the Washington-based Pew Forum on Religion and Public Life estimated that this minority would grow to 2.7 million or 6.6 percent of the population by 2030.

For Canada, it remains to be seen just how popular this new law will be. France?s experience could be instructive.

As the Monitor?s Robert Marquand wrote in July 2010, the French ban benefited from a strange coalition of far-right French nationalists and liberals attempting to reinforce French notions of secularism and feminism on the French Muslim minority.

"As politics, the burqa is beautiful,? Marquand quoted Pap N?diaye, an opponent of the French ban, and expert at Paris?s School for Advanced Studies in the Social Sciences. ?It is a minor real issue with huge political effect and social meaning. It allows an alliance between the right and left. The left, on progressive, secular, feminist grounds; the right, as a sign of the dangers of an Islamic identity."
